The
bill (Reg. No.4179) offers a new version of the
Law "On the Proclamation of Amnesty in Ukraine" adopted by the Verkhovna Rada
of Ukraine in 1996.
V. Shvets, Committee Chairman, reminded that before the second reading of the bill, the subjects of the legislative initiative referred 54 proposals, among them 26 were taken into the consideration fully or partially, and 28 were rejected.
V. Shvets singled out the following novelties of the bill:
prohibition of amnesty during the inquest, pre-trial stages of proceedings and, if a criminal case undergoes judicial proceedings, but is not examined by the court;
extension of the register of the convicted not liable to amnesty;
alteration of the procedure of discharging the convicted from the extra punishment.
In connection with the invalidation of the Law on the possible amnesty during the inquest and pre-trial stage of proceedings, the relevant amendments shall be introduced to clauses 44, 86 of the Criminal Code of Ukraine and clause 6 of the Criminal Procedural Code of Ukraine. Furthermore, the Criminal Procedural Code of Ukraine is supplemented with a new clause 6-1 that defines the order of discharging an individual in the result of the amnesty act.
The Committee members upheld the bill. They are convinced that its adoption will strengthen human values in the society, and prevent amnesty of the individuals convicted for grave and especially grave crimes.
