Volodymyr Lytvyn, Chairman of The Verkhovna Rada of Ukraine, believes that the Parliament should promulgate the Text of the Constitution in its Resolution

 

"From the legal point of view, the Verkhovna Rada of Ukraine should promulgate the text of the Constitution in its resolution, as the parliamentary archive contains the text of the Constitution of Ukraine of 1996 and all the documents appertaining to its adoption," V.Lytvyn stated in Yalta on Friday. 

"I suggest passing the law on the rules of implementation of the Constitutional Court resolution, as an utterly important legislative act is concerned," he stressed. 

 

The Head of the Parliament stated that this law should suggest that The Verkhovna Rada promulgated an authentic text of the Constitution "to confer legitimacy to the implementation of the Constitutional Court resolution and prevent any further discussions."  

 

V.Lytvyn supposes that this law should also fix the procedure of implementing the Constitutional Court resolution in part of the period of authorities of the power bodies, including the President of Ukraine, The Verkhovna Rada and the local authority agencies. 

 

According to the lawyers of the Verkhovna Rada, 700 laws were adopted after the enactment of the Constitution of Ukraine with the amendments of 2004. Thus, 40 legislative acts must be amended to implement the Constitutional Court resolution.

 

However, V.Lytvyn disagrees with those who believe that only the Law on the Cabinet of Ministers can be amended.  He noted that the issue on appointment of judges to the administrative offices arises, as the Constitution of Ukraine of 1996 delegates these authorities to the Head of State, while the Constitution of 2004 does not. Moreover, it is necessary to fix the procedure of appointing the ministers and other officials who used to be appointed by the Parliament on nomination by the Cabinet of Ministers, but shall be appointed by the President of Ukraine now.

 

"These issues must be considered to prevent any conflicts and to demonstrate implementation of the Constitutional Court resolution regardless of its personal support or rejection," the Chairman of The Verkhovna Rada of Ukraine concluded.
