The bill (Reg. No.6697) amends the
Civil Code of Ukraine and the Law "On Notaries."
The amendments to clauses 1247 and 1304 of the Civil Code define that the wills verified by the notaries or other officials mentioned by clauses 1251-1252 of this Code, as well as the data on succession treaties, shall undergo the compulsory state registration in the Succession Bureau in the order adopted by the Cabinet of Ministers of Ukraine.
Pursuant to clause 8 of the Convention on the Establishment of a Scheme of Registration of Wills, any person has the right to receive the information on the character and date of will completion and notary who has an access to the will in the succession bureau (under the condition of showing the death certificate or other documents verifying the fact of death of the testator). Thus, the bill amends clause 8 of the Law "On Notaries."
Furthermore, the Committee members emphasised that the amendments to clauses 56 and 57 of the Law "On Notaries" envisaged compulsory registration of wills in the Succession Bureau.
