Mykola Azarov, Chairman of the Committee, listed ten Bills offered for consideration by Parliament.
The Bill 'On Amendments to the Law, 'On Financial and Credit Tools, and Property Management in Housing Construction and Real Estate Transactions', The Bill purports to create additional indemnity for investors investing in Housing Construction, in the event of an early Termination of Contract due to the delayed commissioning of Real Estate facilities.
Planned for consideration are two Bills on Amendments to the Law, 'On Insurance' aimed at promoting the effective involvement of Home Insurers in International Insurance relations, and improving the protection of our citizens, (with regard to their rights, whilst travelling as tourists.
Also included in the list of Bills subject to consideration are proposals from The President of Ukraine, 'On Amendments to the Law ‘On the National Bank of Ukraine' aimed at improving provisions for the greater independence of The National Bank of Ukraine and its Managing bodies; changing the Term of Office of The President of the National Bank of Ukraine, and clarifying grounds for his dismissal, etc. The President, in his proposals, suggests that Clauses are added to the Law, laying down additional requirements for those who may become Members of the Council of The National Bank of Ukraine.
Also recommended for consideration is the Bill on Amendments to the Law, 'On Non-State Retirement Benefits', purporting the efficient organization and operation of the Non-State Retirement Funds, with taking account of the specific features of their different types; relations between Non-State entities providing Retirement Benefits; rights and duties of financial institutions who manage funds, etc.
It is planned to table a Bill in March, 'On Amendments to Several Laws of Ukraine (appertaining to the Regulation of Banks' activities)'. It was prepared to accommodate the procedure for State Registration of Banks with special Legislation in the area of State Registration of legal entities. It will enhance Banking supervision and the organisation of External Audits of Banks, improve the protection of a Creditor's Rights, and provide internal financial monitoring with the aim of preventing Banks from being used as ‘Money Launderers´ of criminally-derived income.
A further Bill to be tabled is entitled, ‘On The Currency Regulation System and Currency Control in Ukraine´. It proposes to regulate the basic rules for currency regulation and currency control in Ukraine, and envisages the introduction of new terms; determination of currency regulation and currency control principles; institution of the obligatory sale, by residents, of foreign currency in Ukraine´s currency market; permission for physical persons, residents of Ukraine, to open bank accounts beyond Ukraine, etc.
In the outcome of deliberations, Committee Members resolved, first of all, to hold a Round Table on this issue, inviting relevant experts and currency market players to join the discussions.
Planned for tabling is a Bill ‘On the Institution of an Accumulative System for Obligatory State Retirement Insurance´, aimed at laying down a procedure for introducing the obligatory Retirement Insurance Accumulative system. The Bill proposes to set a date for the commencement of remittance of Insurance Contributions to The Retirement Insurance Accumulative System, i.e. 1 January 2009; to fix the categories of persons for whom obligatory participation in the Insurance System is required; to set the calculation base and level of Insurance Contributions; and to decide on the steps necessary to ensure the smooth operation of The Retirement Insurance Accumulative System.
In May, The Committee intends to consider the Bill, ‘On the Legalization of Income obtained by Legal Entities and Natural Persons´. This Bill aims to lay down legal and organizational principles for legalizing the ‘shadow´ income of legal entities and natural persons not connected with serious crimes against the fundamental principles of Ukraine´s National Security, Health and Safety, an individual´s will, the peace and security of mankind, International Law and Order, and in the area of drug trafficking.
