The Law (Reg.No.0861) lays down the Legal, Organizational and Financial principles for the regulating of social relations arising from the redemption for social purposes, and on the grounds of social needs, of land plots in the ownership of individuals or legal entities.

 

After deliberation of The President's proposals, The Committee were unable to agree with his motion to reject this Law.

 

It was stressed at the Meeting that today, when \ market land relations are still being formed, Land Ownership Rights cannot be absolute, and should fulfill a social function, similar to that of other countries, providing for the realization of the social interests of Individuals, State and Territorial Communities. The partition of almost all agricultural lands, The People's Deputies noted, was carried out without taking into account the development needs of the City, as well as those of the Mining industry, Transport and other sectors of the economy. Without adopting this Law, it is impossible to resolve the above problems, together with  problems related to the construction of facilities for EURO 2012.

 

At the same time, several comments included in The President's proposals deserve attention, and can be allowed for during their further elaboration. These are comments relating to a compensation procedure for property located in the land plot at its redemption, redemption price information, clarification of provisions on the cost of a land plot, redemption price indexation, and bringing this Law in line with The Constitution and Laws of Ukraine.

 

Committee Members, drawing on the Opinion of The Central Scientific Experts Office within The Office and Administrative Department of The Verkhovna Rada, suggest that The President´s proposals concerning a clear-cut differentiation between the notions, 'Redemption of a land plot', and, 'Forced alienation of land plots on the grounds of social needs', be included, together with the proposal on bringing several provisions of the Law in cohesion with the Laws 'On the Natural Preservation Fund', and 'On Environmental Protection'.
