The Bill (Reg. No. 1011-15) aims at securing due State control over budgetary spending and adherence of public funds administrator to the requirements of effective legislation in the field of State procurement.
Inter alia, it is proposed to increase minimum cost limit for obligatory realization of the legally established procurement procedure cost of goods and services from 20 to 30 thousand Hryvnias, for works from 50 to 200 thousand Hryvnias. The list of procurement articles not subject to legal regulations is extended. Thus, the said list will include lease of office premises in case the term of lease is extended, works of fine arts, books, natural gas, documents on education, State decorations of Ukraine, orthopedic items, orthopedic footwear, and other procurement articles of social purpose.
A number of tender offers required for holding tender is reduced from three to two offers. It is also expected to introduce the regulation concerning free publication of announcements about scheduled purchasing.
The regulations concerning the List of Dishonest Participants and the List of Purchasing Procedure Participants are to be excluded from the effective Law. The regulations concerning suspension of payments by the State Treasury of Ukraine (by banks-operators) in case the Tender Chamber of Ukraine appeals against purchasing procedures, decisions, actions or inaction of the customer, are also cancelled.
The Bill enhances criteria of tender offers valuation and includes statements concerning procedure of appealing against purchasing procedures by means of establishing the court appealing procedure.
