This Bill (Reg. No.1233) has been drafted by the foremost Law experts, drawing on the conclusion of the Venice Commission, proposals from scholars, scientists, practicing lawyers, and public, as well as the Code version drafted by the Task Force for the Second Reading.

 The Draft Code envisaged that the 'Procedural Criminal Law will be also applied to criminal proceedings in the case of a crime committed within Ukraine's Diplomatic Representation in a foreign country, or on board an aircraft, or river/sea vessel beyond Ukraine, under Ukraine's Flag or Identifying Sign, where said aircraft/vessel is registered in an airport/ port within Ukraine.

Also, 'Where the International Treaties of Ukraine provide for extending the jurisdiction of Ukraine to the members of Ukraine's Armed Forces stationed in foreign countries, proceedings in the case of a crime committed within the said foreign country against an individual from said personnel shall be effected under a procedure, as laid down by this Code'.

The necessity of drafting this Bill, states the Explanatory Note, results from the Resolution, taken by the Council of Europe Parliamentary Assembly on 5 October 2005, concerning the finalizing of the new version of the Draft Procedural Criminal Code of Ukraine.

The Authors consider this Bill to be conceptually different from those so far considered by The Verkhovna Rada of Ukraine of preceding Convocations, including that approved at the First Reading.

The Authors believe that the passing of this Bill will allow an acceleration in the realisation of the Judicial Reform and observance by Ukraine´s of commitments to The Council of Europe.
