These proposals is included in the Bill 'On Amendments to the Business Code of Practice' and state that 'a claim provision' is not allowed through the passing of a judgment relating to imposing a ban on convening meetings of shareholders (members) of a Company and taking decisions by them; provision by a Registrar, Holder or Depository of a Registered Certificate Holders' List, or any information on the shareholders that is required to convene their meeting; attending of shareholders´ meetings by shareholders and defining the authority of General meetings held by shareholders.

 

The authors of this Bill consider its passing necessary in view of the widespread misuse by Judges in taking claim provision measures, thus providing legal opportunities to interested parties to unlawfully take over the Business´s management.

 

They believe that once this Bill has been passed, the Judges will no longer be able to misuse their authority in passing judgement on a claim provision, and exclude the takeover of the Business´s management.
