A relevant Bill amending Chapter X of the Transitional Provisions of the Land Code of Ukraine (appertaining to Agricultural Land Sale) was introduced to The Verkhovna Rada of Ukraine by the People´s Deputy K. Vashchiuk.
The Bill (Reg. No.1051) proposes to establish a Ban on the sale of agricultural land in State or Municipal ownership, together with the sale, or alienation, together with a change of usage, of land used for agricultural production or private farming by individuals or legal entities, who have already taken ownership of this land, or will do so before 1 January 2010, from the lands of agricultural enterprises or land shares. It also proposed to define the law regulating the procedure for agricultural land exchange.
The Author of the Bill brings to attention the expiration on 1 January 2008 of the Ban on the sale of agricultural land in State or Municipal ownership, etc, by virtue of Paragraph 15 of the Transitional Provisions of the Land Code of Ukraine. In her opinion, the major condition underpinning the introduction of the agricultural land market was the passing of Laws on the Land Market and the State Land Survey. However this condition has not been yet met, since the said Bills have not yet been passed.
The Author believes that the passing of this Bill will allow for a package of Laws to be prepared to avoid any possible abuse of power and criminal actions concerning land ownership, as well as preventing the pauperization of the Ukrainian people and the buying up of Ukrainian lands by home and foreign tycoons.
