The Bill (Reg. No.1080) proposes to eliminate  collisions in the current legislation, resulting  from the implementation of the Administrative Legal Procedure Code and  provide an exact delineation of  cases  for referral to the Administrative Courts.

The Bill envisages that  'Also included within the competence of the Administrative Courts will be disputes arising between  public authorities or those acting on their behalf in exercising their authorities, with regard to their   administrative competence, their delegated authorities included, together with disputes arising from the concluding, execution, and termination of Administrative Contracts'.

The Author considers that the Administrative Courts will be authorized to effect legal investigations dealing with amendments to, or termination of Administrative Contracts.

S. Mishchenko is of the opinion that the passing of this Bill will allow the clear-cut delineation between the competence of Civil (Commercial) and Administrative Courts in resolving disputes related to the concluding, execution, amending and termination of administrative contracts, and will contribute to the consistent and correct application of the Law.
