Two committees are today in focus:

Committee on Family Matters, Youth Policy, Sports and Tourism …recommends the Parliament to take it in the first and second readings a bill amending the laws of Ukraine “on Olympic, Paralympic movement support and sports of the highest achievements in Ukraine”, and “on physical culture and sports”.

The draft bill No.6648 proposes to replace the wording "disabled person" in all cases with the wording "a person with a disability" in the relevant cases.

During the discussion, the members of the Committee supported the legislative initiative of the Government, since the implementation of the bill would bring the current legislation on physical culture and sports of persons with disabilities in line with the law of Ukraine on ratification of the Convention on the Rights of Persons with Disabilities (CRPD) and its Optional Protocol.

   At the same time, the сommitteemen disagreed with the procedure of entry into force proposed by the bill – “from the day following the day of its publication” (paragraph 1 of Section II “Final Provisions” of the bill), since its implementation requires a comprehensive renewal of the by-law legal framework, for which the Ukrainian Cabinet is given just three months (paragraph 2 of Section I of the bill), and a number of practical measures to be taken.

With this in mind, the Committee recommends that the law be enacted at least three months after the day of its publication.

Nota bene. Guiding Principles of the Convention on the Rights of Persons with Disabilities:

There are eight guiding principles that underlie the Convention and each one of its specific articles:

a.      Respect for inherent dignity, individual autonomy including the freedom to make one’s own choices, and independence of persons

b.     Non-discrimination

c.     Full and effective participation and inclusion in society

d.     Respect for difference and acceptance of persons with disabilities as part of human diversity and humanity

e.      Equality of opportunity

f.       Accessibility

g.     Equality between men and women

h.     Respect for the evolving capacities of children with disabilities and respect for the right of children with disabilities to preserve their identities.
 

Committee on Legislative Support of Law Enforcement

recommends the Verkhovna Rada of Ukraine to take it on the first and second readings a bill amending the Criminal Procedure Code of Ukraine to improve a       summons’s content.

The members of the Committee considered the bill No.6402 amending the Article 137 of the Criminal Procedure Code of Ukraine to improve a summons’s content at a session on September 6.

The above bill proposes to expound the clause 4 of the first part of the Article 137 of the Criminal Procedure Code of Ukraine as follows: "denomination (record number) of criminal proceeding in pursuance thereof an exaction is exercised,   date of its entry in URPI, substance of criminal proceeding subject to procedural action a person is exacted against".

The draft bill author M. Palamarchuk, MP, introduced amendments to the Article 137 of the Criminal Procedure Code of Ukraine, having grounded it by the need to provide some extra defensibility for participants to criminal proceeding, and give access to criminal proceeding information. MPs voted in favor of this legislative initiative.
